Followed by "anti-blue cheapest eyeglasses online" for children and adolescents, favored by the majority of parents, many businesses in order to promote products and even use such advertising terms as "prevent myopia" to fool consumers. Can "anti-blue light" glasses prevent blue light? Can it really "prevent myopia"?
Brief of the case
Shanghai Putuo District market supervision Bureau according to the relevant reporting clues, found an e-commerce platform official flagship store suspected of publishing false advertising, then launched a case investigation.
After investigation, the parties in order to promote the promotion of a children's anti-blue light glasses products sold in the online store, the use of advertising terms such as "blocking 98% harmful blue light" and "preventing myopia" on the product page.
Legal analysis
After actual investigation, the children's glasses products sold by the parties have a blue light blocking rate of 98% in the spectral range of 385nm to 415nm, and a blue light blocking rate of only 30% in the spectral range of 415nm to 445nm. According to existing scientific understanding, harmful blue light refers to the blue light in the spectral range below 445nm, that is, the children's glasses sold by the parties only have a 98% blocking effect on the harmful blue light in part of the spectral range.
In addition, there is currently no sufficient medical evidence to prove that anti-blue light glasses products have significant effects in the prevention and control of myopia, etc., and the parties can not actually provide relevant proof materials that the glasses they sell have the function of preventing myopia.
Therefore, the party, as an advertiser, misled consumers by making false and misleading publicity about the efficacy of the products in order to promote the anti-blue light glasses for children sold in its online store, in violation of Article 4 of the Advertising Law of the People's Republic of China, which stipulates that "advertisements shall not contain false or misleading content, and shall not deceive or mislead consumers". The advertisements issued by the company constitute false advertisements as referred to in Article 28 of the Advertising Law of the People's Republic of China.
In the end, the Putuo Market Supervision Bureau imposed a fine of 50,000 yuan on the illegal acts of the parties and ordered them to eliminate the impact within the corresponding scope.
